WYNGO Terms and Conditions
Effective date: 11 September 2026
Last updated: 11 September 2026
These Terms and Conditions (the “Terms”) govern your access to and use of the WYNGO mobile application and related services (the “Service”). The Service is provided by:
WYNGO d.o.o.
Trg republike 5
1000 Ljubljana
Slovenia
Email: wyngo@wyngo.ai
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use WYNGO on behalf of a company or other organisation, you confirm that you have authority to accept these Terms on its behalf. In that case, “you” includes that organisation where applicable.
1. The Service
WYNGO provides AI-assisted sales-call support, transcription, suggestions, summaries, conversation analysis, practice scenarios, synthetic voice features, and related tools. Available features, AI models, speech providers, usage limits, and supported platforms can change as the Service develops.
WYNGO is an assistive tool. It does not make decisions for you and does not replace your professional judgement.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a contract to use WYNGO.
An account is required. You agree to:
- provide accurate and current account information;
- keep your credentials confidential;
- promptly notify us if you believe your account has been accessed without authorisation; and
- remain responsible for activity performed through your account, except where caused by WYNGO’s failure to apply reasonable security.
You may not share an individual account with another person or use another person’s account without permission.
3. Calls, Meetings, and Other Participants
WYNGO processes microphone audio and conversation content when you activate live or practice features. This may include the voices, statements, and personal data of other participants.
Before activating WYNGO during a real call or meeting, you must:
- clearly tell all participants that AI-assisted listening, transcription, and analysis will take place;
- explain that audio and conversation text will be processed by WYNGO and external speech and AI providers;
- obtain consent where required by law, workplace policy, contract, or the circumstances; and
- stop using WYNGO if a participant objects or if the processing is not lawful.
You are responsible for determining whether you are permitted to use WYNGO in each call, country, workplace, and context. An in-app reminder or device permission does not by itself make a call lawful.
If an organisation provides or requires the use of WYNGO, that organisation is responsible for ensuring that its users and call participants receive the required notices and that the use of the Service complies with applicable law and workplace policies.
You must not use WYNGO to listen to, record, transcribe, or analyse a conversation that is not intended for you, to conduct covert surveillance, or to evade another person’s privacy rights.
4. Artificial Intelligence
WYNGO uses third-party AI, speech-recognition, and synthetic-voice technology. The specific provider or model used can vary by feature, language, availability, and technical configuration.
AI output is generated automatically and can be inaccurate, incomplete, outdated, misleading, or inappropriate. You must review AI output before relying on, sharing, or acting on it.
WYNGO does not provide legal, financial, medical, employment, compliance, or other regulated professional advice. You remain responsible for your communications, sales decisions, representations, offers, commitments, and compliance with applicable laws and professional obligations.
You must not present AI-generated content as verified fact or as the statement of another person when it is not.
5. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- violate privacy, data-protection, recording, employment, telecommunications, consumer-protection, intellectual-property, confidentiality, or other applicable laws or rights;
- use WYNGO for covert monitoring, harassment, discrimination, fraud, deception, impersonation, or manipulation;
- submit content that you do not have the right to use or disclose;
- use the Service to make solely automated decisions that produce legal or similarly significant effects for another person;
- attempt to obtain passwords, authentication credentials, payment information, or other unnecessary sensitive information from a participant;
- introduce malware, interfere with the Service, bypass security or usage controls, probe for vulnerabilities without written permission, or access another user’s data;
- reverse engineer, copy, resell, sublicense, or commercially exploit the Service except where applicable law expressly permits it or we agree in writing;
- use automated means to extract data or place unreasonable load on the Service; or
- use the Service to develop or train a competing product or model using WYNGO’s non-public technology, prompts, interfaces, or outputs, except with our written permission.
We may investigate suspected misuse and restrict or suspend access where reasonably necessary to protect users, third parties, WYNGO, or the Service.
6. Your Content
You retain ownership of content you provide to the Service, including notes, prompts, goals, feedback, and content from conversations where you or the relevant rights holder owns that content (“User Content”).
You grant WYNGO a limited, non-exclusive licence to host, transmit, reproduce, process, adapt, and create derived materials from User Content only as needed to provide features such as suggestions, summaries, and analysis; secure, support, and maintain the Service; comply with law; and exercise or defend legal claims. This licence ends when the relevant content is deleted, subject to limited legal retention and provider or backup cycles described in the Privacy Policy.
You confirm that you have all rights, permissions, notices, and legal bases required to provide User Content and allow it to be processed as described in these Terms and the Privacy Policy.
Do not submit trade secrets, privileged information, special-category personal data, payment-card details, passwords, or other highly sensitive information unless this is lawful, necessary, and expressly authorised by the relevant organisation or person.
7. WYNGO Content and Licence
WYNGO and its licensors own the Service, including its software, design, branding, documentation, prompts, workflows, and other materials, excluding User Content.
Subject to these Terms and payment of any applicable fees, WYNGO grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Service for its intended purpose during the applicable account or subscription period.
No rights are granted except those expressly stated in these Terms.
8. Feedback
If you provide suggestions or feedback about WYNGO, you allow us to use that feedback to operate and improve the Service without payment or attribution. This does not give us permission to publish your identity or confidential User Content.
9. Subscriptions, Billing, and Credits
WYNGO offers subscription plans through Apple App Store and Google Play. The available plan, price, billing period, currency, trial or introductory offer, renewal terms, and included usage are displayed before purchase and form part of your agreement.
Paid subscriptions automatically renew for the selected billing period unless cancelled before the renewal date. Apple or Google charges the payment method connected to your store account and handles the payment transaction under its applicable terms.
You can manage or cancel a subscription through your Apple App Store or Google Play subscription settings. Cancellation normally takes effect at the end of the current paid billing period, unless the store or applicable law provides otherwise. Deleting the WYNGO application or your WYNGO account does not automatically cancel a subscription.
Refund requests are handled by Apple or Google under the applicable store rules and mandatory consumer law. Nothing in these Terms limits any refund, conformity, termination, or other consumer right that applicable law gives you.
Plans may include credits or usage allowances. Credits measure access to eligible Service features, have no cash value, cannot be transferred between users, and cannot be redeemed for money. Unless the purchase screen expressly states otherwise, unused credits expire at the end of the applicable subscription billing period and do not roll over to the next period. The purchase screen and plan description specify the allowance and billing period that apply to a plan.
If a payment fails, a subscription expires, or the available allowance is exhausted, paid functionality can be restricted until access is restored, renewed, or upgraded.
10. Privacy
Our Privacy Policy explains how WYNGO processes personal data, including microphone audio, transcript text, account information, session content, purchases, AI processing, retention, and deletion.
By using features that require microphone or third-party AI processing, you acknowledge the relevant in-app disclosures and permissions. Where consent is the applicable legal basis, you can withdraw it as described in the Privacy Policy.
11. Third-Party Services
The Service depends on third-party platforms and providers, including Apple, Google, AI model providers, speech providers, infrastructure providers, and OpenRouter. Their availability, output, and technical behaviour are outside WYNGO’s direct control.
Your use of Apple App Store, Google Play, Apple sign-in, Google sign-in, or another third-party service is also subject to that provider’s terms. Use of the iOS application is additionally subject to Apple’s applicable Licensed Application End User License Agreement.
Third-party outages, model changes, platform restrictions, or provider decisions can temporarily affect the Service or require WYNGO to replace a feature or provider.
12. Service Availability and Changes
We aim to provide a reliable Service, but uninterrupted or error-free availability is not guaranteed. Maintenance, security incidents, network failures, provider outages, legal requirements, or product updates can interrupt or change the Service.
We may add, modify, replace, or discontinue features where reasonably necessary for product development, security, compliance, or third-party availability. Changes will not impose an additional charge during an existing paid billing period without your agreement.
If a change negatively affects a consumer’s access to or use of the Service and the effect is more than minor, we will give clear advance notice where required by law. The consumer may terminate the affected contract free of charge within 30 days after receiving the notice or after the change takes effect, whichever is later, unless we allow the consumer to keep the unchanged Service without additional cost and the Service remains in conformity with the contract. Any refund or other remedy required by applicable law remains available.
13. Suspension and Termination
You may stop using the Service at any time. You may delete your account through the application settings or follow the instructions at https://wyngo.ai/delete-account.
We may restrict or suspend access if we reasonably believe that:
- you materially or repeatedly breach these Terms;
- your use creates a security, legal, or privacy risk;
- payment is overdue or your subscription has ended;
- suspension is required by law, a court, a competent authority, or a platform provider; or
- immediate action is needed to prevent harm to another person, WYNGO, or the Service.
Where appropriate, we will give notice and a reasonable opportunity to correct the issue. We may terminate an account immediately for serious unlawful, fraudulent, abusive, or security-threatening conduct.
Account deletion and data retention are governed by the Privacy Policy. Ending the account does not affect obligations or rights that arose before termination, including payment obligations, intellectual-property rights, lawful retention, disclaimers, and liability provisions.
14. Warranties and Consumer Rights
The Service is supplied with the level of care and conformity required by applicable law. If you are a consumer, you retain all mandatory rights concerning digital services, including available remedies where the Service does not conform to the contract.
Subject to those mandatory rights, WYNGO does not guarantee that:
- AI output will be accurate, complete, suitable, or achieve a particular sales result;
- every provider, model, language, device, or integration will always be available;
- the Service will meet requirements that you did not communicate to us; or
- use of the Service will itself satisfy your legal, regulatory, employment, or contractual obligations.
15. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
WYNGO is responsible for loss that is a foreseeable result of our breach of these Terms or failure to use reasonable care. We are not responsible for loss caused by your unlawful use, failure to inform call participants, reliance on unreviewed AI output, unauthorised disclosure of content, or breach of these Terms.
If you use WYNGO for business purposes, to the maximum extent permitted by law:
- WYNGO is not liable for indirect or consequential loss, lost profit, lost revenue, lost opportunity, loss of goodwill, or loss caused by business decisions made using AI output; and
- WYNGO’s total aggregate liability arising from the Service during any 12-month period is limited to the amount paid by you for the Service during the 12 months before the event giving rise to the claim.
The business limitations above do not apply to consumers where prohibited by applicable law.
16. Business Indemnification
If you use WYNGO for business purposes or on behalf of an organisation, you and that organisation will, to the maximum extent permitted by law, indemnify and hold harmless WYNGO, its affiliates, and their personnel from third-party claims, liabilities, damages, and reasonable legal costs arising from:
- unlawful listening, recording, transcription, analysis, calling, messaging, or other communications carried out by you or your personnel using the Service;
- failure to provide a required notice, obtain required consent, or establish another required legal basis;
- User Content that infringes another person’s privacy, confidentiality, intellectual-property, or other rights; or
- a material breach of Sections 3, 5, or 6 of these Terms by you or your personnel.
This obligation applies only to the extent the claim results from your or your organisation’s acts or omissions. It does not apply to the extent a claim results from WYNGO’s breach of these Terms, negligence, intentional misconduct, or other responsibility that cannot lawfully be excluded. WYNGO will give reasonable notice of an indemnified claim and allow the indemnifying party to control its defence, provided that no settlement may admit fault by or impose an obligation on WYNGO without WYNGO’s prior written consent.
This Section applies only to business users and organisations, not to consumers acting outside their trade, business, craft, or profession.
17. Governing Law and Disputes
These Terms are governed by Slovenian law, without regard to conflict-of-law rules.
If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of residence. You may bring a claim before any court that has jurisdiction under applicable consumer law.
If you use the Service for business purposes, the courts in Ljubljana, Slovenia, have exclusive jurisdiction, unless mandatory law requires otherwise.
Before starting formal proceedings, please contact wyngo@wyngo.ai so we can try to resolve the issue directly.
In accordance with Slovenian law on out-of-court resolution of consumer disputes, WYNGO does not recognise any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer may initiate under that law.
18. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, security requirements, or third-party platforms. We will post the updated Terms and change the date above.
If a change materially affects an active paid subscription or your rights, we will provide reasonable advance notice where required. Where applicable, consumers retain the termination right described in Section 12. Changes do not apply retroactively unless required by law or necessary to address an immediate security or legal risk.
19. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver of the right to enforce it later.
You may not transfer your account or rights under these Terms without our permission. WYNGO may transfer these Terms as part of a merger, acquisition, restructuring, or sale of the Service, provided this does not reduce mandatory consumer rights.
These Terms, the Privacy Policy, and the purchase terms displayed before subscription form the agreement between you and WYNGO concerning the Service.
